FALLON COUNTY RESOLUTION 1138 – INTENT TO SELL REAL PROPERTY

RESOLUTION DECLARING FALLON COUNTY’S INTENT TO SELL THE FOLLOWING REAL PROPERTY

FALLON COUNTY RESOLUTION 1138

WHEREAS, pursuant to Section 7-8-2521, MCA, the Board of County Commissioners (the “Board”) has authority to sell real property, and has adopted Resolution 2018-15 providing procedures and guidelines for the sale of real property, and WHEREAS, the Board is considering whether to sell the following real property.  If approved, the Property will be sold for not less than its appraised value of $352,000 or highest bid. 

TOWNSHIP 7 North, RANGE 59 East, M.P.M., Fallon County, Montana

Section 15:  Parcel 1 as shown on COS 0110599, Book 1P at Page 393 of the records of Fallon County, Montana, containing +/-227.11 acres

EXCEPTING AND RESERVING UNTO THE COUNTY, A 60’ WIDE WATERLINE EASEMENT & RIGHT-OF-WAY which includes the right to enter upon the easement to grade, level, fill, drain, build, maintain, repair and rebuild a water line, together with such appurtenances as may be desirable within and across the ground embraced within the right-of-way.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF FALLON, MONTANA:

  1. The Commission is considering whether to sell the above property.
  2. The Commission would like to consider County resident’s opinions whether in support or opposed to such sale and on whether the Property is useful to County business.
  3. The Commission will consider acting on a Resolution to Sell the Real Property on October 28th, 2024 at its regular meeting at 1:30 p.m.  Unless the County is persuaded that the property is useful to the County, the Commission intends to pass a Resolution to Sell the Real Property. 
  4. Interested persons may provide their opinions and feedback at the Meeting scheduled above or provide written opinions and information prior to that date. 
  5. The Clerk is directed to provide notice of this resolution by having it published in the Fallon County Times for one week prior to the scheduled meeting, and additionally ensure notice is posted on the Fallon County website, posted in the courthouse and notify all adjacent landowners by mail.
