RESOLUTION OF INTENT NO. 1127 – Adopting 2024 Fallon County Growth Policy Update – Fallon County Board of County Commissioners

A resolution of intent by the Fallon County Board of County Commissioners to adopt the 2024 Fallon County Growth Policy Update, establishing a date for a public hearing and creation of a 30-day public comment period.
WHEREAS, The Fallon County Commissioners tasked the Planning Board with the preparation of an updated Growth Policy for Fallon County, AND;
WHEREAS, The Planning Board approved an action plan incorporating public input and an approximate timeline for the adoption of an updated Growth Policy for Fallon County, AND;
WHEREAS, The Planning Board conducted a series of public meetings, online surveys and outreach to encourage public participation in the preparation of the updated Growth Policy, AND;
WHEREAS, The Planning Board considered several strategies and policies that could be adopted by the County Commissioners to implement the updated Growth Policy, AND;
WHEREAS, The Planning Board encouraged both written and verbal testimony on issues and items of concern related to the future growth and development expected to occur during the life of the new updated Growth Policy, AND;
WHEREAS, The proposed Growth Policy update addresses all of the statutory components of a Growth Policy found in 76-1-601, MCA to the extent acceptable to the Fallon County Board of County Commissioners, AND;
WHEREAS, The Planning Board did conduct a public hearing of the Growth Policy update on March 12, 2024. Additionally, the Planning Board did take the matter under advisement for a term of not less than 30-days prior to making a decision to recommend adoption of the updated Growth Policy and Implementation Strategy to the Fallon County Board of County Commissioners.
WHEREAS, The Fallon County Commission continues to work cooperatively with the City of Baker and Town of Plevna through their consolidated Planning Board on planning, subdivision and land use related issues, AND;
WHEREAS, The Fallon County Board of County Commissioners are desirous of establishing and maintaining up to date growth management regulations including but not limited to Development Standard, Subdivision, and Floodplain Regulations, AND;
WHEREAS, The County is statutorily required to examine and update the Growth Policy on a time frame not to exceed five (5) calendar years, AND;
WHEREAS, Fallon County Board of County Commissioners are desirous of providing persons who may be affected by the adoption of the Growth Policy update ample opportunity for involvement in the adoption process, AND;
WHEREAS, 76-1-604 of the Montana Code Annotated provides the process for the adoption, revision or rejection of the Growth Policy by the County Commissioners.
NOW, THEREFORE, BE IT RESOLVED, by the Fallon County Board of County Commissioners to adopt Resolution of Intent Number 1127 and hereby open a public comment period for 30 calendar days during which persons may comment upon the Growth Policy update. Said comment period will expire upon April 18, 2024. Further notice of the passage of this resolution of intent shall be published in the Fallon County Times not less than twice during the comment period and a public hearing on the updated Growth Policy is scheduled for April 22, 2024 at 2:00 PM.
Persons desirous of commenting upon the Growth Policy update shall submit their comments in written form to:
